The StarBazaar Platform is governed by this Privacy Policy (“Privacy Policy”) read with the Terms and Conditions. Accessing, browsing, or otherwise using the Platform indicates your agreement to all the Terms and Conditions, so please read them carefully before proceeding or if you are not agreeable to terms herein, please refrain from using the Platform. This Privacy Policy explains how StarBazaar collects, stores, uses, transfers, and discloses your information. This Privacy Policy is subject to change at any time without notice and StarBazaar encourages you to review this Privacy Policy periodically.

1. Applicability

This Privacy Policy applies only to information collected on or through our Platform. It does not apply to any information collected offline by StarBazaar, unless specifically stated. This Privacy Policy explains StarBazaar’s information practices in connection with the Platform, such as the types of information we collect and how we may use that information. Please review this Privacy Policy carefully. In addition, please review the StarBazaar Terms and Conditions (“Terms and Conditions”), which governs your use of the Platform. Please note that certain features or services referenced in this Privacy Policy may not be offered on all of the Platform, and certain features or services may not be offered on the Platform at all times.

2. Information Collection

We and our third-party service providers collect certain information about your use of our Platform (“Usage Information”). Usage Information may include the browser and operating system you are using, the URL, advertisements, or search terms that referred or otherwise led you to the Platform (if applicable), aspects of the Platform that you use or visit, the products or services you access or view, the types of requests and videos that you send, and the time of day you accessed the Platform, among other information.

Usage Information also includes the IP address or other unique identifier (“Device Identifier”) for any computer, mobile phone, or other device (any, a “Device”) used to access the Platform. A Device Identifier is automatically assigned to your Device, and our servers identify your Device by its Device Identifier. Please note that your IP address may be included in the header information of every video notification email that we send for your videos. Some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of a Device used to access the Platform. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information.

At Starbazaar.pk, we are committed to protecting your privacy and ensuring the security of your personal data. If you wish to have your personal information deleted from our records, you can request it by contacting our Data Protection Officer (DPO) at support@starbazaar.pk. Upon receiving your request, we will take reasonable steps to promptly and securely delete all relevant data, subject to any legal obligations that may require retention. Please note that some residual information may remain in our backups and archives for a limited period, but we will ensure that it is not accessible or used for any other purpose. By using our website, you acknowledge and consent to the data deletion practices described in this clause.

3. Information You Provide

a. The Platform may request that you provide certain personally identifiable information, which is information that may reasonably be used to identify you as a specific individual (“Personal Information”). Examples of Personal Information include your name, e-mail address, username, address, and phone number. The Platform may also request additional information about you, such as payment information, demographic information (e.g., your gender, ZIP code, or marital status), or information about your preferences and interests. The Platform may require that you provide certain information to use the Platform or certain features, and the required information may change from time to time depending on, among other things, the nature of your relationship with us. If we combine demographic or similar information with the Personal Information we collect, we will treat the combined information as Personal Information under this Privacy Notice.

b. The Platform may also enable you to transmit files or otherwise provide information to StarBazaar. Please note that files you transmit may contain metadata, which may contain Personal Information about you. For example, photos & videos you transmit could include metadata indicating where (e.g., GPS coordinates) and when (date and time) the photo or video was taken.

c. When you submit a request for a Shoutout, StarBazaar collects the information pertaining to the request including for example, your name, contact information, the name and contact information of the receiver, your payment details, shipping and delivery information, and the relevant information is shared to the extent necessary to enable us to provide you with the delivery of your request submitted.

d. Any Promotion that StarBazaar offers shall have its own terms and conditions that you may review before participating in any such contest/promotion.

e. StarBazaar collects the information that you provide in connection with us providing you customer service.

f. StarBazaar also collects information submitted to us as content or communication from the Customer and the Creator including but not limited to a Shoutout request, the Shoutout Video, reviews, pictures, emails, messages, social media communications, Creator Content etc. Each Request and all Creator Content is subject to the applicable Terms and Conditions. As a result, others may access it, use it, and share it in accordance with the Terms and Conditions.

g. From a Creator, we collect, in addition to information provided when you create your account, your name, email address, telephone number, and the ID’s to your Social Media Accounts, StarBazaar Shoutouts and other offerings prepared by you, and other information relating to our relationship with you, such as payment information. Payment provided to you shall be from a third-party payment provider and StarBazaar is not responsible for the Terms and Conditions and Privacy Policy of any Third Party.

4. Information Third Parties Collect

a. We may receive information about you from third parties. For example, if you are on another website and you opt-in to receive information from StarBazaar, the other website will forward your contact and other information to us so that we may contact you as requested. Further, we may receive certain information about you from third parties if you engage the third parties in connection with our Platform – for example, if you download one of our Apps from an app store, make an in-app purchase, connect via Social Features, or make a payment using a third-party payment provider, consistent with the privacy policies of the applicable third parties.

b. We also may supplement the information we collect with outside records from third parties to provide you with information, services or goods you have requested, to enhance our ability to serve you, and to tailor our content to you. We may combine the information we receive from those other sources with information we collect through the Platform. In those cases, we will apply this Privacy Notice to the combined information.

5. Cookies and Tracking Technologies

a. A cookie is a data file placed on a Device when it is used to visit a Platform or otherwise access our online content. Cookies may be used for many purposes, such as remembering you and your preferences and tracking your visits to the Platform. Certain web browsers and certain browser add-ons, such as Adobe Flash, may provide additional local data storage mechanisms that are used in a manner like cookies, and some of the content included on our Platform may make use of this local storage. Some cookies are essential to the functioning of the Platform, and, without them, some features, and services you have requested cannot be provided. If you disable cookies, adjust privacy settings on your device, restrict local storage, or otherwise limit these technologies, you may not be able to use some of our Platform features.

b. We work with certain third parties (including network advertisers, ad agencies, payment processors, and analytics companies) for a variety of purposes. These purposes include providing us with information regarding traffic and use of the Platforms and our advertisements on the Platforms and across the Internet, and to engage in multi-site advertising. For example, if you click on an advertisement that led you to one of our Platform, our service provider(s) may be able to tell us which advertisement you clicked on and where you were viewing the advertisement; or, you may be served StarBazaar advertisements elsewhere online based on your visit to or use of the Platform. Some of these third parties may collect Personal Information when you visit the Platform or other websites or online services. Additionally, we may share certain information derived from your Personal Information with third parties to assist us in delivering content or advertising to you, both on the Platform and elsewhere online.

c. Third parties may set and access their own tracking technologies (including cookies, web beacons, and embedded scripts) and may otherwise collect or have access to your Device Identifier, Usage Information, and related information about you. These service providers may use that information for their own purposes, including to target advertisements to you, prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you. We may share the Device Identifier and Usage Information about visitors with third party advertising companies, analytics providers, and other vendors for similar purposes.

d. Web Beacons: Small graphic images or other web programming code called “web beacons” “clear GIFs” or “1×1 pixels” may be used on the Platform or in our emails and may be invisible to you. Web beacons may be connected to your Personal Information if you have provided it. Web beacons may be used for various purposes, such as counting visitors to the Platform, monitoring how users navigate the Platform, counting how many emails that were sent were opened, or counting how many times a link was accessed. We do not sell, rent, trade, or otherwise distribute information about you gathered through the web beacons or 1×1 pixels with any third parties, except for third parties who provide us with advertising, marketing, research, or analysis services.

e. Embedded Scripts: An embedded script is a programming code that is designed to collect information about your interactions with the Platform, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to the Platform and is deactivated or deleted thereafter

f. StarBazaar does not control the information collection, use, or sharing practices of third-party analytics providers or advertisers. Some of these parties may collect your Personal Information when you access the Platforms or other online websites and services.

g. Other Technologies: We may also use other technologies that collect similar information for security and fraud detection purposes.

6. Tracking

StarBazaar does not currently alter our practices when we receive a "Do Not Track" signal from a visitor’s browser except as specifically required by law.

7. Use of Information Collected

a. We may use information about you, including Personal Information and Usage Information, to:

(1) allow you to use the Platform or to provide related customer service;
(2) provide or offer you information, products, or services, any of which may be tailored to you;
(3) send or display special offers or advertisements from StarBazaar and our business partners;
(4) process your registration, including verifying that information you provide is active and valid;
(5) process a transaction you initiate;
(6) improve the Platform and our products, and for internal business purposes, including the measurement of the Platform’ effectiveness;
(7) contact you with regard to your use of the Platform and, in our discretion, changes to our policies;
(8) identify and protect against fraudulent activities, transactions, and abuse of the Platform, and to protect the rights and property of StarBazaar, its partners, and customers; and
(9) as otherwise described in this Privacy Notice, for purposes disclosed at the time you provide your information, or with your consent.

b. We may use the location information for a variety of purposes. Unless otherwise stated, this location information is not tied to your Personal Information; and you may be able to prevent the collection of your location through your device settings.

c. If you contact us for customer support regarding the Platform, we will not use the information you provide to contact you for marketing purposes unrelated to your request unless you agree otherwise.

8. Information Sharing

The information you provide us may be shared with:

a. StarBazaar Partners and Affiliates: As relevant, for the same purposes for which StarBazaar uses it;

b. Third-Party Service Providers: Who are performing services on behalf of StarBazaar (only for the purpose for which the information is acquired and to comply with legal requirements);

c. Third Parties or Public: In relation to any Promotion, in line with the rules and conditions of the Promotion;

d. Opt-In: Information you opt-in and provide consent to share;

e. Administrative Or Legal Purposes: We may disclose your information, including Personal Information and Usage Information, to third parties

(i) if we are required to respond to subpoenas or other legal process or if in our opinion such disclosure is required by law;
(ii) at the request of governmental authorities conducting an investigation;
(iii) to protect and/or defend the Platform or any of the StarBazaar’s rights and property, or to enforce the Terms and Conditions or other policies applicable to the Platform; or
(iv) to respond to an emergency or otherwise protect the personal safety, rights, property or security of StarBazaar or any third party. We may also use Device Identifiers, including IP addresses, to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers, or law enforcement agencies in our discretion.

These transfers and disclosures may be carried out without notice to you.

f. Protection of Third-Party: We will disclose your personal information to third parties when we believe the disclosure is necessary to protect rights, property, or safety of another. For example, we disclose personal information relating to a Platform account if we in good faith believe that a Platform account is being used in ways that are harmful to another or contrary to the applicable Terms and Conditions.

g. Business Transfers: In evaluating or engaging in a sale of assets, merger, acquisition, reorganization, bankruptcy, or other transaction, we reserve the right to disclose, transfer, or assign your personal information and communications. By providing your personal information, you agree that we may transfer such information to the acquiring entity without your further consent.

9. Children

The Platform are not intended for children without parental supervision, and STARBAZAAR does not knowingly collect information from persons younger than the age of Eighteen (18). If we learn that we have inadvertently collected information from a person younger than the age of 18, without the consent of the person’s parents or legal guardians, we will take commercially reasonable efforts to delete that information from our databases.

10. Data Security

We take commercially reasonable steps to help protect and secure the Personal Information submitted to us against unauthorized or illegal access, modification, or destruction. For example, if you enter sensitive information such as a credit card number and CVC number on our checkout forms, we or our service partners use transport layer security (TSL) technology to help protect the sensitive information during transmission. However, please note that transmission over the Internet or wireless networks and the electronic storage of information cannot be guaranteed to be 100% secure. Therefore, we cannot ensure or warrant the security of any information we collect. You use our Platform and provide us with your information at your own risk.

11. Notice to Customers Outside PAKISTAN

Please be aware that information we collect through the Platform may be transferred to and processed in Pakistan, where the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. By using the Platform or providing us with any information, you acknowledge and consent to the transfer, processing, and storage of your information in Pakistan, or such other countries as StarBazaar may choose in its sole discretion.
